We aim to process all enquires and requests as quickly as possible, but we reserve the right to restrict, refuse or cancel orders, as well as refuse access to the website and terminate accounts at our discretion.

We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when placing your order.

Pricing

Lotus has taken every care in the preparation of the content of this website, in particular we try to ensure that all the prices shown on the website are accurate. Where a product’s correct price is lower than that paid, we will refund the difference to you, and dispatch your order in the usual way. Where the correct price is higher you will have the option of proceeding with the order at the correct price, or cancelling the order. Where a reduced price is shown on sale, the item(s) have been on sale at the higher price for 28 days or more.

Reduced products will show the ‘now price’ and ‘was price’ with banners reflecting the discount level by £ off or % off. The reductions shown are reductions from the original ('was price') charged on the website. Pricing and availability information is subject to change without notice.

All prices are quoted in UK pounds sterling. All prices are inclusive of VAT but do not include delivery or any customs charges (where applicable).

Prices of goods displayed in and ordered through the website may differ from prices in store.

Sales & Discount Codes
Only one discount can be applied per basket, discount codes can not be applied to items that are already in sale.

How your order is processed

After you have placed an order with us, we will send an email acknowledgement of that order to your designated email address. This email is a confirmation and acceptance of your order.

If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call and refund when necessary.

Availability

Our acceptance of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. Please note that dispatch estimates are not guaranteed and that dispatch times should not be relied upon as such.

Payment

Payment can be made using the following major credit and debit cards:
Visa, Visa Debit, Visa Electron, Mastercard, Maestro. We also accept payment through PayPal.

Governing law and jurisdiction

The agreement between us shall be governed by and interpreted in accordance with English law and the jurisdiction of English courts.

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions.

Right to cancel this agreement

Under the Distance Selling Regulations, you have fourteen working days starting the day after delivery (the ‘cooling-off period’) in which to cancel this agreement, if for any reason you are not happy with the goods that have been delivered.

If you wish to cancel this agreement, you must notify us, and return the goods that have been delivered to you. Goods are refunded within 14 days.

How you can cancel this agreement

Please contact us as soon as possible if you wish to cancel your order by emailing us or calling 0161 652 5768 (Monday– Friday 9am – 5pm) or by going through our website. Orders can only be cancelled before processing/dispatch has begun.

Once your order has been cancelled, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

How Lotus can cancel this agreement

We reserve the right to cancel the order if:-

• We have insufficient stock to fulfil your order

• We are unable to obtain payment

• We do not deliver to your area

• A product fault or an error in the product description has been identified

All rights, including copyright, in the text, graphics and layout of this website and in all software and software compilations are owned by, or licensed to, Lotus.

You are not permitted, without our prior written consent, to copy, transmit, reproduce, publish, display, distribute, store, modify or adapt this website, its contents or underlying software, except for personal non-commercial use.

Accuracy of content

We have made every effort to ensure that the products are fairly described, that the product information is correct, and that the colours of our products are displayed as accurately as possible. However, as the actual colours you see will vary with the quality of your monitor, we cannot guarantee that your display will accurately reflect the colour of the product requested on delivery.

If, on receiving ordered goods, you have any cause for dissatisfaction you may return them via our returns procedure, which is explained above.

We are entitled to delete any material from our website at any time and we will not be liable for deleting or not storing any material that you may transmit to us.

Social Media Terms & Conditions

We love seeing all your amazing posts on social and so sometimes we reach out to customers via social media to request use of their images & videos that have been posted on social platforms for marketing purposes. If we contact you and you are happy for us to do so, by clicking on the link that is sent to you in your direct messages and submitting ‘yes, I agree’ or by responding #YesLotus on a post, you agree to the following:

1. You grant Lotus, a royalty free, perpetual, worldwide licence to use your social media handle and your social media photograph(s)/video(s)/reel(s) on Lotus's platforms (including but not limited to Instagram, Facebook & TikTok), on Lotusshoes.co.uk and for Lotus's marketing and/or in their organic advertising and/or paid advertising on Meta platforms, Pinterest and TikTok.

2. Lotus may use, reproduce, distribute, combine with other materials, alter and/or edit your photos in any manner to its sole discretion.

3. You hereby represent and warrant that (i) you own all rights in and to your photos/videos, (ii) you have permission from any person(s) appearing in your photos/videos to grant the rights herein, (iii) you are 18 years or older and (iv) Lotus’s use of your Instagram handle and/or photos/videos will not violate the rights of any third party or any law.

4. You hereby waive any moral rights in the photos/videos to which you are now or may be at any future time entitled under Chapter IV of Part I of the Copyright Designs and Patents Act 1988 or any similar provisions of law in any jurisdiction.

5. You hereby release and discharge Lotus from all and any obligation to pay you for any use of your photos/videos and any of the intellectual property rights contained therein in connection with the uses described above.

6. You hereby release, discharge and agree to hold Lotus and any person acting on Lotus’s behalf harmless from all claims, demands and liabilities whatsoever in connection with the use of the photos/videos as described above.

Social Media Competitions

Please read these Terms and Conditions carefully. By entering the 12 Days of Christmas competition, you indicate that accept these terms and conditions and you agree to be bound by them.

2. Eligibility: This competition is open to anyone resident in the UK, who is eighteen (18) years of age or older. Employees and immediate family (defined as parents, children, siblings, spouse, and life partners) of the Promoter or its affiliates, subsidiaries, advertising, or promotion agencies are not eligible to enter this competition.

3. How to Enter: Instagram access required. To enter, you must follow the official Instagram account of Lotus (identified as @lotusshoes1759). Entrants are further required to like the competition post and tag another account in the comments section. More than one entry is allowed per person; share on IG stories for an extra entry. Lotus reserves the right in its absolute discretion to exclude blatant attempts to breach the terms of the competition; such entries will not be accepted. No purchase is necessary. No entries from agents or third parties or entries automatically generated by computer will be accepted. Incomplete or corrupted entries will not be accepted. Entries will only be accepted if they comply with all entry instructions.

4. Use of Data: All details provided by you will be held by the Promoter and used in accordance with these terms and conditions and the Promoter’s Privacy Notice available at https://www.lotusshoes.co.uk/privacy-policy-i4

5. Dates: The competition commences on the 1st December 2024 and ends on the 9th December 2024

6. Receipt of Entries: The Promoter cannot be held responsible for network, computer, or software failures of any kind, which may restrict or delay the sending or receipt of your entry. The Promoter is not responsible for entries not received and/or any lost entries.

7. Prize: Entries received between 00:00 on 1st December 2024 and 23:59 on 9th December 2024 and which comply with the entry requirements will be eligible for the prize draw. There will be one winner who will receive the prize as stated in the competition post on Instagram. The prize cannot be retrospectively applied to bookings made prior to the date of your winner notification email. The prize is as offered; no extensions or upgrades are available. No refund can be offered or cash value for the prize. If the prize is shoes and these do not fit the winner, an exchange will be offered.

8. Selection of Winners: The winner will be chosen at random from all eligible entries and notified by the official Lotus Instagram account @lotusshoes1759 within 28 days after the closing date.

9. Notification: The winner will be notified by email within 28 days of the closing date with instructions on how to claim their prize. If a winner cannot be contacted or is unable to accept their prize, the Promoter reserves the right to choose another winner from eligible entries received so please ensure your email address and contact details are correct.

10. General: The Promoter reserves the right to amend the competition in exceptional circumstances. All entrants agree to abide by these terms and conditions, and the Promoter reserves the right to exclude entrants for any breach of these terms and conditions. The Promoter’s decision is final, and no correspondence will be entered into.
